** UPDATE**

Hospital phoned me on Friday to apologise that they hadn’t noticed I had fractured my sternum in the accident plus they asked me to go to A & E tell them my details and they will fast track me for CT scan (passing blood so went to the Drs). Turns out it’s tissue damage around my left kidney :(

And then we have sunny Monday FFS!

Insurance company aren’t paying out due to rear spoiler, rear diffuser and side skirts! Skirts ok but the other 2 no idea :x

I’ve asked for the assessor to give me a call!!

Anyone wanting Saturday nights lottery numbers???

If they cancel his insurance though, he becomes an uninsured driver and the other company will run riot with that.
 
First and foremost concentrate on your health and fitness.

If you've haven't declared the obvious modifications on your car you insurance company are well within their rights to cancel your insurance. Getting insurance in the future will be expensive and difficult if you have a policy canceled.

I would seek legal advice. Even though you were not insured properly, if you aren't at fault you might still be able to claim.

It might just be for the injuries caused. The only other thing is if you're insurance company cancel your policy you'll lose any legal protection cover you have. You'll either have to make the claim yourself, pay for a solicitor, or use a no win no fee solicitor.

If your insurer is going to deal with the claim that suggests they have cancelled the policy because the car is a write-off, not because of modifications, but you need to get clarification. Whatever the reason that doesn't stop you claiming from the insurer of the car responsible.

Given that you now have a claim for personal injury as well I'd be looking for a no win, no fee solicitor.
 
I know :o 2 chest X-rays and wasn’t picked up. 2 weeks later a quality assurance type guy picked it up! Plus I had to lie on my front arms up on the CT scan, reckon I took a step back in the healing process :(
 
I hope you are feeling better despite the efforts of your insurance company to make you pee even more blood! I always thought if your car was written off the insurance policy would die with it? I believe the insurance companies are using forums to find out who has modified their cars.

Sorry to hear of your troubles.
There’s an expression in medicine that in the Emergency Department, the sickest are seen by the thickest! Usually, they are staffed by junior doctors fresh out of internship who are “supervised” by registrars and distantly by consultants. If you were walking wounded and treated in minors, you might not have seen a doctor at all.
Sternal fractures aren’t easy to spot on plain xray, but they are common so should be actively sought both clinically and on trauma films. If in doubt, a low-dose CT is a cheap and quick means of establishing the answer and to exclude underlying lung or mediastinal injury. It should be readily available from ED.
Eventually, all ED xrays are reported by a radiologist and then calls are made to apologise for the missed diagnoses! Previously, that would have happened within 24-48h, but the NHS is in a very sorry state now.
Fortunately, the delay is unlikely to have compromised your recovery.
It’s not too surprising that your insurance company will proceed with you claim, since they are not likely to be called upon to make any payment and they will be able to charge the other company for their time!

That's exactly what I thought when I read the statement, anyway how do they know if those parts were fitted or not when you purchased the car and you may have believed they were fitted when new.

Anyway, take it easy and recover - oh and get the e89 far more usable & sensible
