Advice on 2nd hand iPod Nano

Hey,

Just bought a second hand Nano, it's 4gb and is full with songs which I like. However, I've just realised its eligible for this:

Happy days, so I will send it off and get a 6th Gen 8gb.

The one I've bought is from my friend's wife, however I've tried to copy all the songs over using 'Sharepod'. It's worked great but now I've realised that it only plays the songs which have obviously been downloaded to the original Nano from CD. When I try and play others it says I need a password as it was purchased from iTunes by Sally (previous owner). Now I don't expect her to give me her password as I understand you can assign it to 5 accounts. But questions are:

Is there anyway of having these songs without password (legally?!) on iTunes/computer so when I get the new 6th Gen through I can put them on that?

If not, how can I see which are purchased and which are copied from CD's so I can just delete the purchased ones, save me sifting through thousands of songs!

I very much doubt it, and legally no anyway because it's 5 devices for that owner. Just because a song was downloaded legally, doesn't mean your not then sharing it illegally...
