My insurance company replaced my sandblasted windscreen on my old E36, no questions asked. They said it was hazardous and must go. I didn't need to take a brick to it. I don't think clay bar and rainX will do much to solve the problem although it helps a little bit. Replacement is the way to go.
On my Zed, my dealer broke the windscreen when they replaced my steering column under warranty. Needless to say I got a free one out of it, dealer installed and good as new. I have had a bad experience in the past with aftermarket replacement though, be sure and insist on all OEM parts, no exceptions.
