Another Update, BMW Pedestrian Protection System

@Pondy, I've sent the complaint to the ombudsman on Monday, which was the same day I had my new dash cam fitted, fool me once.....

@ori, that's how they now, in their eyes, why it correctly operated, the sensors had been deformed sufficiently for their to be a detectable (above a threshold) change in resistance in two of the four sensors, that is why they are stating it is not a warranty issue.

My argument to them and the ombudsman is that, as there is no physical sign of impact, then it is either two faulty sensors or a calibration/sensitivity issue.

In which case their refusal to foot the bill seems nonsensical! :banghead:

As Iain said above, if that's the case, what did they think you had hit at 30mph which caused no damage whatsoever but set the system off?

For me that changes your chance of success. Makes absolutely no sense that you could have hit anything at 30mph and there be no damage to the car anywhere.

That’s what I was saying! ;)

It’s a crazy thing to suggest that anything can trigger it at 30mph and not leave a single mark on the car.

Yep, but for BMW, it's what I can prove, hence the dash cam that cost me £2k, £300 for the camera and fitting, £1,700 because I didn't fit it 12 months ago!

Have to say, I think the dealer was a little sympathetic, but they are not going to do me any favours because I've never bought a car from them, and they're in the business of making money, so they charged my £240 to paint the new hinges :headbang:

So I also think they have to prove an element of it.

See how you get on with the ombudsman and if that fails, I would go down the small claims court.

I would also get an independent assessment done by a professional to get their opinion. This way you may have a case made for you both for ombudsman and for potential legal challenge.

At 30mph a bird strike would smash your windscreen, yet bmw bumpers magically return to shape? Additionally if the number is removed, there would be internal evidence that the bumper is warped, even if the external was magically perfect…..which it wouldn’t be.
 
Are they affected by shadows, maybe from a tree, the car sensors it and thinks it’s a solid object.
 
@MikeyH, no they're pressure sensitive, fitted inside a tube on the inside of the bumper, when the bumper moves back it squishes the sensors and the resistance increases.
 
Just received an email from the motor ombudsman, stating that they have completed an initial review and have decided to investigate my case and will be back in touch when it is assigned to an investigator :thumbsup:

That's a good start. I hope you get somewhere with this. If you do and BMW UK get a rap on the knuckles, it may help others with less than clear cut warranty claims. Who knows?
 
The bumper is pretty flexible if it was hit by a pheasant or a fox at 30mph it would likely bend enough to trigger the bonnet and may not leave any damage. However it would be quite a bang you would notice it, in that case you could claim on insurance. (Keep the dead fox as proof)

There must be records of animal impacts and what gets damaged or triggered, maybe that could be used to help any case
 
@deltasierra, I'm 99.9% sure that I didn't hit anything, I certainly didn't see any road kill on my way back home. That's the thing though, I cannot prove that I did not hit anything, the absence of evidence is not the evidence of absence - gee thanks Karl :(
 
This is exactly what pisses me off more than anything about stealers, they’ll force their tongue so far up your butthole it tickles your molars in the showroom, but as soon as that car has driven off the premises you’re nothing but a pain in the arse unless you’re handing over gazillions for an oil change. 🤬

And now the long wait.

I really hope you resolve this. Being hit by a phantom thing that can trigger an expensive repair is unacceptable.
