Speeding...

Well I got busted on Sunday evening, 52 in a 30. Which seems bad until you realise you are in a 50 zone which then switches to a 30 for a row of houses and then back to a 60. The jobs worth was sat in an unmarked civic on the edge of the 30 with a lazer gun.

I didn't know the area, I was 150 miles from home after watching the BTCC and heading to Bouremouth for the night.
I was following a random car for a few miles which apparently was only doing 40 which is what confuses me.

So it looks like I have 3 points (had a clean license) and £100 fine, which annoys me the most.
Probably a long shot but is there anything I can argue with this? Single copper on his own? Lazer gun enough proof?

Nahh nothing can be done I don't think mate

Unless it's not been calibrated but chances are it would've been calibrated so all the copper needs is that as proof
 
Just got to take the hit I reckon Mark. Got stung recently doing similar (62 in a 50 which was in only a short section of a 70). Trousers down for Essex Police and 3 points on my license, in the post en route from South Wales.
 
Is 52 in a 30 still in the 3 points arena rather than court?

I reckon you could be looking at 6 points there and possibly a summons. It depends I suppose. If it is a short 30 stretch like that they might be lenient on you as you aren't local. Hope so. Good luck :thumbsup:
 
Why are you moaning. You were doing nearly double the speed limit outside someone's house. Stop whining, open your eyes and try and notice the speed limit signs.... It's not rocket science....

No, he told me that if I had hit 60 I'd have been going to court, which is fair enough. He was a nice bloke, just very by the book. I just don't understand how the car in front was only doing 40, he didn't appear to slow.

There's no speed camera signs, no camera either, but residents apparently complain a lot about this stretch of road. Wessex police don't offer driver awareness courses apparently.

I'll just have to take it on the chin, I'm normally cautious and aware about my speed, hence a clean license.

My brother was doing a similar speed a few years ago in a 30. A young girl on a bike rode out in front of him and the impact killed her. He tried to argue in court that his speed was not so bad, given the layout of the road. Prat. He got an 18 month sentence and served 9. He has to live with the guilt.

Be grateful you'll get away with a fine and a few points.
 
I forgot this forum is full of 24/7 law abiding saints, I wish I'd never asked :roll:

I love how some people get on their high horse, you don't even know me, it's the second in time in 13 years I've had points for speeding, people make mistakes. I bet there are people on here with 6+ on their license.
 
Given the use of a mobile speed trap there used to be legislation requiring the signage being clearly visible.

I don't condone speeding but we all have at some point.

Probably end up in a court as general rule of thumb is 10 mph or 20% would be out of the on the spot fines etc.

It's not going to court, it's all done, the fine has been paid, I've just got to send my documents off to dvla today.

I should probably thank myself lucky.
 
Challenging a Speeding Fine
Successfully challenging a speeding ticket can actually occur under certain circumstances. The first point will be to check that all details on the Notice of Intended Prosecution (NIP) are correct. The NIP should include the vehicle’s details, and details such as the time, date and location of the speeding offence. An NIP also comes with a 14 day time limit; this means the alleged offender has received the NIP within 14 days of the offence occurring plus postage time. Be aware that small errors such as typography errors on the NIP will not be grounds for challenging a speeding fine.


Speed Cameras and Speeding Fines
If a Speed Camera was the method used to capture the speeding offence then it may be a good idea to return to the scene. Check that speed limit signs are evident and are placed on both sides of the road. Also check that the speed limits signs are highly visibly and not obscured by obstructions such as trees or bushes. If this is the case then evidence should be taken such as photographic records of the obstructions.
 
Thats lucky you only got 3 points at that speed. So he pulled you over with the blues lights?

I got busted for the first time last yr, eventually everyone will get caught... As even 31 in a 30 is an offence.

What you're asking is.....I did something wrong, how do I get away with it?

Yeh you're unlucky, the road layout may be confusing to a non-local, but the fact is you were doing 52 (which means probably an indicated 55-57 on your speedo, so you were knowingly "speeding" in the 50 also) in a 30...take the punishment on the chin and be more aware next time. Nobody is claiming to be a saint on here, nor have I seen sign of any high horses, just people pointing out the obvious.
 
Mark i feel for you buddy i am not sure what your facing but hopefully a fine and just points. Yes that sucks but you where caught fair cop and all that.

I think we all have done similar sometimes we get away with it sometimes we dont.

All the best anyway and as DR-Z pointed out it can always be far worse.

How old was the girl?
Did her parents take any responsibility for letting her ride her bike on a road where she (presumably) wasn't able to judge the speed of the traffic?
If he had been doing 30mph rather than 50ish, would he still have hit her (i.e. did she just ride straight out in front of him)?

It's easy to make it sound as if driving in excess of the posted speed limit was the sole causal factor in an accident, whereas it may have been down to a combination of a number of factors. The government's own statistics show that only 4% of accidents have excessive speed as the main causal factor.
