Speeding Fine

Returned home from work today to find a speeding fine from the Sunday before last. I honestly don't remember if I was but it says I was doing 81mph in a 70mph limit so not the sort of thing that would stand out as everyone does 80 in a 70 anyway.

The strange thing is that they have not offered me a fixed penalty or anything yet they have just asked me to confirm who was driving it that day. I think it was a speed gun rather than a camera as the website said no image was available and the device that they used has the word laser in it. The website also says it was last tested for callibration in July so can I query the fact it may not be 100% accurate.

I think it's ridiculous that they are trying to fine me over 81mph (if that is true) I never drive dangerously such as up other driver's backsides like some people do and always leave a good distance between me and the next car but all they think about is speed and not speed in relation to the conditions.

They will not give you an offer as they don't know who they are giving the offer to until you have done the S172 request. Once you fill in the request, they will return the form with a fixed penalty offer, or depending where you committed this hideous crime, a course instead.

Had no idea that there was such a thing as automated speeding tickets! I have heard of red light cameras but never this, sounds like Big Brother is getting out of control!

I feel your frustration but it is impossible for a non-human device to properly judge if you are speeding responsibly. It is programmed to analyze your speed versus the limit and issue a ticket if it is over the limit. :(

Frustrating, annoying, etc. but frankly just pay up, take the fine and move on.

The next generation of linked cameras in final field tests and up for full deployment in January will freak you - grids of up to 15 miles in area checking average speed at every entry and exit and any in between point.

Ok, what you have received is an NIP (Notice of Intention to Persecute Prosecute). This just asks you to confirm who is driving. Once you have done that they will send you the penalty notice or offer of "speed awareness course".

81 in a 70 should be just 3 points and £60, I think.

@pvr: sorry, missed that you had answered this already.

Just class it as "Fun Tax" and move on!
I've had a few "Fun Tax" stamps before now! Make them drag it out by asking for the photo/proof first. I have a couple of nice shots of me on my motorbike! :P

I thought the camera had to be calibrated the day of use. Bound to be info on the web on that.

It's all a bit arbitrary and the makes the general public disangage from the law-enforcement system.

Feel for you mate worry every time i go out it will deffo be 3 points and £60 fine for that speed or if you are lucky a course but that would really piss me off being done for 81 mph.

You could try the " there were two of us sharing the driving and I honestly can't remember who was at the wheel at that time" excuse. Without confirmed ID of the driver at that point in time they can't pin the fine on you......................allegedly.

The Hamilton defense you mean? That now carries 6 points if you try it as too many people were doing that one.

Bugger, edited that too late! That's the one! Surely they can't just fine you for having a feasible but unlikely defence. They would have to prove you were full of BS........allegedly.

Guilty until proven innocent, remember. If you don't prove who was driving, you, as the registered keeper will get the 6 points to discourage you from even trying.

They now will introduce that you can not even get the costs back even if you win in court for traffic offenses. The UK court system is well and truly buggered when it comes to traffic offenses.

That sucks. It might be worth investing in a copy of the "Drivers survival guide". I've been tempted a few times but never got round to buying it. Seemingly it's written by an ex traffic cop and tells you all the legal loopholes................... allegidly again.

Thanks for all the feedback guys, I have now sent off confirmation that i was driving (no point in winding them up) but have asked to see both pages for the certificate for the device that registered my speed as only the first page is whown on the Police's website.

While travelling back from Birmingham down the M1 last night I was ultra carefull with my speed but eventually crept up to about 77mph before slowing down again as everone else was going faster than me.

They will ignore your request as they only reply if you have not confessed or go to court. You have signed your life away, so next will be a conditional offer / possibly a course . By asking for the extra information, they "may" just give you an answer that they will only send that if you go to court.
