Roof won't auto fold or close

Hi I am new to the forum. I have read as many threads as possible to find info on this.
Problem- I went to fold my e85 3.0si on Saturday and it unlatched fine, started to move then nothing.....
I bought the car Friday, this happened on Sunday. 2 days after buying the car. My warranty from the dealer ( not bmw or specialist) is for £250 only.

Question- does anybody on here know where I stand with regards to getting this fixed? I am more than happy manually opening/ closing it for now, however not happy I got the car, and 2 days later the roof goes. Any advice of where I stand legally would be great. Ps it worked fine at sale and for the first 36 hours.

Have you checked the tray in the boot, make sure its not in the up position..?

Have you spoken to the dealer yet..??
 
Tray is down. Not phoned bmw, but spoke to the dealer I got out from and he said he will get me a motor of that is the case. I am pretty happy to fit it myself. Just think 2 days after getting the car, it should be fixed out of good will...
 
When you buy a used motor vehicle from a trader, you enter into a legally binding contract and you are entitled to expect that it is of satisfactory quality, fit for purpose, and as described.
If the used vehicle is faulty, you have a short time after buying it to reject it. You may have other remedies such as repair or replacement.
I certainly wouldn't be considering doing it myself.
The symptoms are consistent with a motor failure.
I would put it into writing and give it to the dealer and wait for a response.

I would second dav's advise.

I wouldnt offer to fit it yourself... Getting a garage to do it will be £500 odd worth of labour... And it may not even turn out to be the motor (but based on the symptoms it probably is)

Tell them to take it and fix it, worst case you'll return the car.
