MOT Fail on head light washers

Strange one but the Z has failed on the headlight washers not working. On closer inspection the pump has been electrically disconnected & the water outlet blanked off. They have been like this since I bought the Z but only come to light now! Its a different garage doing the test but the last garage passed it 2 years running with no mention. So is the new garage right to fail the Z ?
 
AFAIK you must have head light washers working with xenon lights- easy enough to reverse previous owners work as he probably just didn't like the mess they make on a clean car.
 
what headlights have you got? I think its a legal requirement for Xeons to have washers but not for halogen lights?

They are xenons The MOT requires them to be on cars from 2010 with xenons fitted but the garage said because they are fitted they must work. The Z is 2006
 
From the MOT Handbook

Vehicles equipped with High Intensity Discharge (HID) or LED dipped beam headlamps may be fitted with headlamp washers and a suspension or headlamp self levelling system.

Where such systems are fitted, they must work; however, it is accepted that it may not be possible to readily determine the functioning of self levelling systems. In such cases, the benefit of the doubt must be given.

Requirement
Where HID or LED dipped beam headlamps are fitted, switch on the headlamps and check the operation of any headlamp levelling and cleaning devices fitted.

Reason to fail
A headlamp levelling or cleaning device inoperative or otherwise obviously defective.


Reasonable to fail as fitted but not working

You are correct, they are not required on pre 2010 cars, however IF they are fitted, they must work. I'd be tempted to remove them, get it retested and pop them back in.

Thanks everyone. so the garage I used before missed them then ! I was lucky for it to pass before then! Was thinking on taking them off but have ordered a new pump less than £20
