Lost my IPhone 5

You could try someplace like Computer Exchange for a legit second hand one... But I am betting they'll still be quite a few hundred quid. People don't think about how expensive these are as devices till they lies or break one - I didn't realise until my Dad dropped his in the loo a couple of years ago. That's why the contract is the contract and you have no right to terminate early without penalty - you're effectively paying off a loan for your device. He claimed on the house insurance, only a £50 excess. Probably your best option.

Contacted Ebay and they think I have a case. Told me to call police.
Called police and they think I have a valid case. Meeting them at 6pm tomorrow.

unless you are covered, the best bet for a replacement one is either ebay (trusted seller and pay by paypal), avforums (for sellers on a forum lie this) or gumtree if you want one local for cash on collection
 
Talking generally of buying new phones after the fiasco of buying what I thought was a new HTC One off Amazon, I will always buy direct from the manufacturer which is what I ended up doing with the HTC which ensures you get a sealed box.

I have claimed a phone on my home insurance in the past, they will usually cover upto £500 excluding water damage.

Good luck though... In this day and age a phone is such a necessity.

I checked the home insurance and it doesn't specify phones so when I get the number, ill give them a call and ask.

UPDATE:

Ok police came round yesterday and took all the necessary numbers, codes and statements. As I suspected because I cannot prove that it was mine on ebay, they cannot do anything. Ebay have removed the listing and its completely vanished. The police are going to add my IMEI number to a database and if it pops up by a store like Cash converters and 2 unique codes match an alert gets sent to the police and they collect it, do the person who sold it and return the phone to me.

Other than that I am going to start a new contract and stay well clear of EE . Gonna go 02, 5GB Data, unlimited calls and texts and only 99.99 upfront cost with a 37per month charge. Cheep !!

EE charged me 37 a month, 1/2 gb data, unlim calls and texts. £179 upfront cost. Huge difference.

Contemplating having an argument with EE to cancel my dept due to the missold contract anyway.

Really not sure you don't just buy a second hand iPhone from a reputable place complete with warranty. Perhaps cost £500. Way cheaper than say 24 x £37 plus £99 = £987.

Seems an expensive way to do it vs just sticking it on a credit card over 12m
 
I think EE are within their rights to tell you that you have to carry on paying your contract. Might be worth asking if you can buy yourself out of it as ultimately, the cost is made up of 2 parts, your handset and your airtime. They may allow you a reduction in the airtime element but you can't expect them to foot the bill on the outstanding finance on your handset because you lost it.

What makes you think your contract was mis-sold?

This is what i would do.

A decent second hand 32gb ip5 is going on ebay for £325-£350 (i nearly sold mine but have it to the wife)

That would be much cheaper then paying for a nee contract.

to save you some more pennies. i have just bought a mint iphone 5 for £300 with 6 months warranty remaining from avforums and signed up to a 3 sim only contract £10 per month, 1gb data, 5000 texts, 600 mins.... or for £15 a month you get unlimited data, 2000 mins voice and 5000 texts

i hate being tied into 24 month contracts as the phones are way out of date come renewal time
