Is cracked wing mirror glass an MOT fail?

Just texted my nephew, who's an MOT tester. He said that if the crack impaired rear vision then he would fail it... :(

Thanks buddy
No problem

I should add that a lot of the MOT regulations are open to a little 'interpretation'... I took my zed to three different MOT testers (not including my nephew) to check my number plates. Two of them initially said that they were illegal and that they would fail the car on that. One then looked again and changed his mind... the other said he wasn't sure. I sent photos to my nephew - he lives 300 miles away from me - he was perfectly happy that they were legal. Go figure...

http://www.ukmot.com/MOT test/Windscreen Mirrors.asp says:

Mirrors
Rear view mirrors must be secure and intact. All rear view mirrors must be adjustable. There must be at least ONE rear view mirror.
Mirrors must show a clear view of the rear view. The MOT tester will use your rear view mirrors to check the operation of the rear lights during the test.
but then http://www.ukmot.com/6-6.asp#Text_top says:
Obligatory mirrors are a. an exterior mirror fitted to the offside (right-hand side when seated in the driver's seat), or b. an exterior mirror fitted to the nearside (left-hand side when seated in the driver's seat), or c. an interior mirror
[...]
all passenger vehicles first used on or after 1 August 1978 [...], must have two mirrors, one of which must be option 'a'.
So the way that I interpret this is that if the broken door mirror is the driver's side, it's an MoT fail. If it's on the passenger side, then you could remove the mirror or glass and stil pass (as you'd have the internal mirror and the driver's side door mirror).
