Gearbox oil leak

Just picked car up from the dealers after having
A few things looked at before the warranty expires.
One thing was that the DCT wasn't changing up gear sometimes
When cold until nearly 3000 rpm.
They say the gearbox is leaking oil and the sump cover is
Damaged and it may not be covered under warranty.
The car was bought a year ago from BMW bury st Edmonds.
We've never hit or scraped the underside of this car and it's
Driven with more respect than any other car we've had.
So where do we stand if they say the gearbox isn't covered.
The car is a 2009 35i and the warranty runs out on the 8th of
August
Any advice would be much appreciated.
 
have you been noticing transmission fluid on drive ?
i know from past experience with my 645ci that fluid can & does leak from the autobox cover which on the 6 is plastic & either warps or splits over time . , ,could your car have similar housing ?
this fault is so common that our american cousins treat the issue as a 3/4 yearly service item .
when mine did the same i spotted it within days & within weeks had the new casing fitted . . no further leaks & £200ish for the part , , £70 for the fitting + a couple of litres of very expensive tranny oil to top up (£27/litre)
 
That might be tricky if there is damage. Perhaps get a local Indy or BMW specialist to also take a look and use their feedback with the dealer?
 
Had the car looked at a local independent re the leak on the
Gear box.
as they said at the dealers the gearbox sump cover
Under tray Was damaged the cover has 4 small drain holes.
It's two of these holes that are five times bigger than they
Should be don't know how this could have happend.
Anyway when the got the tray off 5 bolts and 2 mins later.
(The dealer said they run out of time to take a closer look)
The plastic sump cover on the gearbox is undamaged
It seems to be the gasket thats leaking so I would think this
Will be covered.
 
Had a very similar problem on my E86 with an auto box,the plastic sump cover had warped breaking the seal so the trans fluid was leaking out i had it repaired at the local dealer but it wasn't cheap as the car was out of warranty.

The good thing about it is that i know now it has a new filter and fresh trans fluid.
