Employment contract advice

I've worked at the same firm for the last 7 years and there's 3 of us thinking of branching out on our own. I've never signed a contract of employment and neither has one of the other guys (he's been there 13 years).

The 3rd one of the group has only been with the firm for 4 years and his signed contract includes a "non compete" clause. Basically stating he's not able to work for any competitors for a period of 6 months i think.

How enforceable is this clause. And are me and the other guy clear of "problems" as we've never signed any contract.

Non compete clauses are extremely difficult to litigate against, barely worth including any more. No contract after 8 weeks from start of working is a breach of employment regulations, so you may have redress there anyway. Good luck with your new venture
