Catalytic converter needs replacing.... at 39k!?

Took my car for diagnostic today and there is a code stored saying the cat isn't working properly, is a 56 plate 2.0 with just 39k on it.... surely they shouldn't need replacing at such a low mileage!?
 
It is not normal. If your car has Insured Warranty, the insurance should cover it (see below).

Comprehensive Insured Warranty covers your BMW's mechanical and electrical components for defects that may arise - with the exception of those items specified below:

Batteries, all exhaust components (except Catalytic Converter), brake and clutch facings, discs and drums, bulbs and fuses, channels and guides, weather strips and seals, handles, hinges and check straps, trim, upholstery and cosmetic finishes, wheels and tyres, wiper blades and arms, glass, auxiliary drive belts, coolant and fuel hoses, the cleaning or adjustment of any component, all service items which will require periodic replacement and any item that has worn out rather than suffered from a defect.
 
My wife had a Peugeot that needed a new cat at 3 years old ands 27k miles.Piss por IMO but out of warranty so we had to stump up and get it done.The whole exhaust system fell to bits just in front of the cat.Will NEVER buy a Peugeot again,piece of crap. My brother is running an old company car of mine, 2002 Passat TDi Sport 130,chipped to 170 bhp with 205k on the clock. Still on its original exhaust and cat. Two ends of the spectrum I know, but I feel your cat should last much longer than that.My 3.0 Se is nearly 8 years old with 54k and the cat is fine.
 
Mine went at 50K. Luckily it was still covered under a warranty I got when I got the car second hand. Just make sure they replace the two O2 sensors at the same time as this is good practice.
