For which she has already served a sentence.

I'm not sure either way on this one. Let's face it, we don't have access to all of the evidence but from the information out there it does seem that there are a number of incongruous pieces of evidence.

But, will the US extradite her in any event?

Unlikely as this trial is likely to be considered "double jeopardy" in the US, something they do not support.
That's pretty much what the talking legal eagles on the various news discussion shows have been saying. However, if the legal issue is a close call, which most say it is not, then IMO politics could enter into the decision.
 
I thought I read somewhere that the Double Jeopardy part of the US extradition treaties only applies to a crime if the person has already been tried for that crime in the US - so they shouldn't be tried for the same crime in a foreign court. In this case, she hasn't so it shouldn't apply.

Again, according to the legal talking eagles on TV the extradition treaties with each country contain specific language about this and in fact they named the section of the 2003 treaty with Italy that covers that issue which has been tested before. The one thing that all the legal talking heads agree on is that if she would never be able to travel outside the US without putting herself at risk for an all expense paid trip to Italy and jail.
 
I read somewhere that on the issue of extradition, US law states that they are not allowed to "judge" or have an opinion about the other country's legal system ......

Anyway, .... I have no legal insight whatsoever .... So have no grounds at all for having an opinion .... But listening to her on TV Ive been convinced from the start that she is as guilty as sin ..... :D
 
I read some in depth stuff on this and the double jeopardy does not apply as it is not a retrial, it is a continuation of the same trial and precedents have been set for that.
 
I think it is safe to say that the UK and Italian governments will be having a quiet word with their US counterparts on this. I expect a successful extradition.

Unfortunately the US are pretty handy at extraditing other citizens ...The Natwest 3 comes to mind but somehow see it all differently when it is the other way round
