Absolutely Gutted

So I got in my car after work yesterday and noticed a breeze coming from behind. I noticed that a small section of the rear windscreen had been smashed in. At first I thought that I had done it by slamming ym door too hard (this has happened to me in a previous Mercedes). I got out to inspect, basically a sign and an asbestos roof lining had been blown off and fallen on my car. I went to talk to the guy who owns the building it fell off but he wouldn't even give me the time of day. He said 'oh, thats happened before, I'm not liable.' I called my insurance (traders policy) and they said that is was classed as storm damage and that I'd have to claim on my own policy if I wanted to claim. Needless to say, I am royaly P****d off.
Damage:
Rear windscreen completely shattered.
Rear O/S 108 alloy destroyed.
O/S rear wing dented and scratched
O/S door scrathed and dented
Rear bumper destroyed (need replacement)

I was wondering if anyone here can help me source a rear windscreen. I have found a bumper (Sapphire Black :D ) and got someone to fix the wheel and panels. I am in the North West, Manchester namely. Does anyone know of anywhere (I'm willing to travel far if it saves me enough money) I can get a rear windscreen from?
 
I hate to be the bearer of bad news - the rear windscreen isn't replaceable. The whole roof needs to be changed.

It depends on your insurance policy - Direct line, who I am with, state that if rear screen in a fabric roof is broken they will pay for the cost of a new roof under the glass policy (ie £60 excess, no loss of no claims). Most others I looked at (which may have been a cheaper premium like admiral) do not cover the rear screen if it cannot be replaced independently of the roof.

In which case just claim off your glass insurance?? Irrespective of cause it should be covered
 
And when you've fixed it stick the bastard in Small Claims Court...cheap and easy to do, nobody can jack up costs by involving solicitors etc..., can be done online and the hearings are very informal with the benefit of any doubt frequently given to the plaintiff (thats you!).

Please don't let him get away with it.

Might be worth seeing what your insurer says, they might pursue him for reimbursement, but is it worth the extra cost of insurance etc..., as we all know, even why protected NCD, all they frequently do is sick you in a higher risk bracket after a claim so that your discount, although retained as a %age figure, is from a higher base premium. :(

Absolutely right - go to Citizens Advice and get your free half hour with a solicitor who will advise accordingly. Most good solicitors forms will give you a feee half hour to asses validity of a potential action.
 
Thanks for all the concern. Thanks for the tip jamie, I tried their website but their parts site doesnt seem to be working very well.
My insurance say I can not claim against him (storm damage) even though the sign and roof were not maintained very well. My unlce (a solicitor) will definitely be sending him a bill with a stern letter. Meanwhile I'm just parking all my cars (I'm a car trader) in front of his garage so he can't use it :evil: :evil:
 
As a legal guy, I *really* can't see how he 'can't be liable' for this, ESPECIALLY if it has happened before...

Something fell from HIS building that caused damage to the property of another person. You should pass his details to your insurance company as if he was another car in an accident.

Glad your uncle is able to take this up - the reason I got into law in the first place was because my blood BOILS when I read stuff like this. :evil:
 
So to get this straight:

An asbestos panel fell off his roof, not for the first time.
Damaged your car.
Possibly left asbestos fibres in an enclosed space ie your car
your insurance wont cover the damage.

Maybe the worst possible problem is the asbestos neglect on his part and possibly the route i might take in persuance of damage repair.
However i'm no expert and am sure that somebody will be better educated/experienced to advise.

Hope all goes well with both the repairs and legals.

Did you take any pics of the damage and offending articles .......(he asked, not wanting to appear crass and seem vouyeristic ) :camera:
 
Boy I wish you had that conversation recorded.

Hope the repairs are painless and you recover the losses from him.
 
Wanted to thank everyone for letting me vent. I got my baby back last friday and she is now as good as new. Not a scratch on her :D :driving:
