Contacted the police a few months ago, they said to let the insurance company handle it. Following the case, depending on the court decision, I can then press charges against them.

Without wishing to sound mean, but its been alluded earlier on the thread, I think this is an object lesson in what happens if you sit back and think 'the system' is going to follow due process and act in your best interests. Ditto the bike incident you explained earlier.....you must have done a lousy job of representing yourself at the time for a result like that!
Like I say, not wanting to sound mean but you've got to learn from this to use all the resources at your disposal to fight crap like this. I mean had you engaged a solicitor on the bike thing it unquestionably would have been thrown out.....fine and points avoided, and ditto, police (and solicitor if necessary) on this latest occasion would have avoided a heavy insurance payment that you will never reclaim.
While it might be a PITA to have to fork out for such things when you are innocent, you can see now I'm sure that in the long run its worth it!

chris, your story is def one of warning! i hope to god, that you get the chance to shout down their ridiculous claim - anyone in their right mind can see you are the innocent party. once its all resolved prosecute them and make their lives a misery, the rotten scummy scumbags!!! good luck and keep us posted mate. iain
OMG just read this.... thats horrific... not only have you been screwed by a dodgy claim.. but imo swiftcover have been hopeless (who i am currently with) Whats the point in paying extra for the legal cover?!
What would have happened if you had now sold the car (so no inspection could be carried out?)
Personally i would demand compensation and loss of time/ work from both the third party (which is likely to result in nothing) and Swiftcover.

Trouble is this 'legal cover' is a scam...its only for recovery of costs not covered by your insurance, nothing else.
