3rd brake light rubber

Hi all, I replaced my third brake light with one from Bmw about a year ago but just noticed the rubber has completely come away from the light. Does anyone know if this would be covered under warranty? I don't wish to be spending £70 every year for a new light!

Mine cracked and they denied all knowledge of a warranty... Despite me reading it out verbatim.
Had to write to the CEO in the end was close to going down the small claims route.
