The actual law states that it has to arrive within 14 days under the presumption of the service used. A first class postage presumes up to 2 days delivery times in the worst case, so anything posted within the 2 days of the 14 days expiry rule is not valid if it arrives after 14 days. With the postal strikes the presumption of a first class stamp is more than 2 days so it will get thrown out if arriving after day 14 as they should have known that it will not arrive on time.

The NIP, unless given verbally at the scene or not required because the offence is as the result of a road traffic accident, must be RECEIVED within 14 days by the registered keeper of the vehicle.

If you don't receive it within that time period or it is not in the correct format then it is not lawful.

But to go back to the OPs case, he arrived home to find it there. No proof if it arrived in time or not and he was away on holiday.
So all the supposition about delivery times is something of a moot point in this case surely?

In the case of the OP it was in 5 days, so this has no impact on him. The question was asked before he confirmed that hence it continuing :D

In any case, S128 of the NIP has to be filled in no matter whether it was served after 14 days (identifying the driver). You just have to add the standard served out of time letter which you can download from the RAC website.

Hopefully you’ll be offered a speed awareness course. Whilst these will cost the same as the fine, they (a) don’t come with the endorsement points and (b) you (or whoever the offender was) may learn something from the training event and (c) you don’t have to declare to the insurer. That’s not meant to be rude. I’m a former emergency service worker, been to too many messy incidents caused by speed and been on at least one speed awareness course myself.

If you were not speeding then you’ve nothing to worry about. The cameras are accurately aligned for each carriageway… A

You say the above, pretty much admitting you could have been speeding, then admitting you weren't paying much attention. So you start a thread asking for advice on how to not have to pay for your indiscretion.

So playing devil's advocate, I would say 'suck it up and pay the fine'.

In reality I would fill in the 'mitigating circumstances/ defence' bit of the notice with reams of defence bollox and send it back. It has worked for me many times. I go on the premise that they generally can't be bothered to read all the shite so cancel it and move on to easier fines. :thumbsup:

I had car over take me on the A303. The fixed Camera flashed and likely got a clear shot of both plates. I never heard anything. The other driver certainly deserved to.

Just an observation, but given you got the speeding ticket in the post, the picture must have been clear enough for the issuing authority to read the number plate, identify you as the registered owner, get your name and address, and send the notice? It could be blurry in the letter because its just a cheap printer?
