It looks like I have 2016 (vers 61?) SP-DATEN files of E89 - which I assume is OK??

The info is pretty sketchy on this software isn't it???

I checked my old installation but it was older than that - i've just downloaded the bmw tools from bimmergeeks and the sp-daten files are dated 2016. this is the file I believe tells you the version - is this the same as yours?

I was able to communicate with the drivers side module (although it said there was a version mismatch, not sure if thats standard or not?) but nothing from the passenger side as expected.

Great, I have exactly the same version - thanks for checking.

It may well be I have an issue with the can bus at the drivers seat module (or the module itself of course).

I guess you accessed the module using the same route I showed above under “seat modules”?

yes. mine looks exactly the same as yours. I did wonder if the "(new)" meant that it knew something had changed, but its the same as mine.
