If BMW saw who did it, can you not claim against her?

Ouch ... this story made me wince.

This kind of thing could happen to anyone at anytime. I'm always a bit worried in public parking areas, where some ham-fisted neanderthal could do some serious damage and then drift off without even noticing. I have insurance to cover that type of thing, but as mentioned, that can be a PITA to get sorted out. And it's not just about repairing the damage. There's the psychological injury from having a vehicle you spend hours applying liberal doses of TLC to messed up by someone who's careless and doesn't give a sh*t.

I think that while they have had it for about 8 weeks, it's likely that they (the dealership) would have to assume a duty of care towards a customer's vehicle - it's not like Taz has only just parked it in their car park. During the time they've had it, they would have moved/parked it - if it was in an position where a customer was able to back into it, the question has to be asked 'did the garage do all it could to mitigate the risk of damage?' - hypothetically, if it were in a secured area where one of the main dealer techs caused the damage it'd be obvious the dealer has to sort it out without involving Taz's insurance as the car was both (a) in their care, and (b) damaged by one of their techs. I don't know if my logic is sound but seeing that in Taz's case the damage was caused by the customer, it'd have to be resolved between the dealer and the customer (or their respective insurance companies), again without involving Taz's insurance.

While my dads old M3 was at a garage someone dinged the rear bumper, as a matter of corse my dad was notified, they said they would replace the rear bumper and have it back to him asap. It is a matter of pride, service and reputation. The dealer did a great job and was back to my dad within a week. Although he wasn't happy they did everything they possibly could. Which in my opinion is what they should do.

I doubt any insurance will get involved and they will repair the damage in the same manner, otherwise get in touch with trade standards or give BMW head office a call. They will want to get this swept under the rug ASAP as it is a complete embarrassment to the dealership and the reputation of BMW.

they know who bumped it at they have accepted responsibilty, but still if i have to go through my insurance it will effect my premiums, i feel the bmw garage insurers should deal with it

does my insurance even cover my car whilsts its on a private car park?

you must be reading my thoughts, the car was in perfect condition, i bought it new, i never park in car parks and i treat it like a baby, its been soiled

Suppose it depends what your insurance will ask at renewal? If her insurance sorts it all out you might (hopefully) be ok? It won't be a claim, and isn't an accident, as you werent in it.

If the woman has any decency she'll report it to her insurance. But this may mean you have no control over where it gets fixed (think previous posts may have mentioned?).

You could talk direct to her insurance to find out what the process is?

Then once fixed - send the lads round to her house.....!

Try not to fret to much mate, at least its repairable.....
my baby also had some knob scuff the bumper when i first had it, i insisted the insurance send it to a BMW body shop where in the end i got a brand new rear bumper even though it was literaly a scuff on the edge as i just wasnt happy with the repair, be fussy and make sure you 110% happy....... Know doubt were all the same on here, but i looked at it like this.... in the end its a part thats easily repairable or replaceable at worst... Head up, its not your fault... :-)

Don't even get involved with your insurance, it was there fault let them sort it out. They have a body shop, happened to me though no one else involved when my bumper was damaged just told them to get it fixed, its then up to them to recover the loss

I've not read the other posts, but excuse me if I'm going over old ground.

I'd suggest making BMW pay for it, if you can. The car was under their care; so whether it was hit into by a customer or not is quite irrelevant - they should fix it for you!

My insurance went up quite markedly when someone hit into my (parked) car, so try to avoid involving insurance companies at this point, because even the mention of it can leave a mark on your record. Obviously you're aware that even if you try not to tell your insurance company, if it is claimed via the woman's insurance, it will be recorded anyway, and you'll still have that mark.

Because of the age of the car, I would personally only be taking it to a BMW body shop; purely due to the fact you have a 7 year anti-corrosion warranty, which technically would be void in the area that is resprayed if you were to have any rust problems later in life. With a BMW authorised repair, this wouldn't be a problem. It's not easy to find a decent BMW body shop however; though from the reports I read (and incidentally, who I went with) I would recommend Cotswold BMW. Not a 100% perfect job, but as near to it as you're going to get I'd say, and the colour match was absolutely perfect (which was my primary concern).

I know how you must feel about the car; that it's now not perfect - especially as I know yours is a low mileage car which you only use for fun. What I can say is that I went through all of the same emotions that you probably are right now, and even though I didn't think it at the time, it does get easier. The process of getting it fixed is NOT nice, but once it's all finished and back to you, you'll never think of it as having had a repair done - or at least I didn't, and I am very fussy about, well, everything.

There may not be any positive side, but try to think of one, somehow. For me, my sideskirt was chipped in the usual place (at the back, where it 'flicks' out), and of course the car came back without any marks. Whilst it was in the shop, it also allowed me to rectify the front bumper where the previous owner had slightly dinged it, and it meant it was cheaper.

I hope some of that helps, and it isn't too much of what others have already said.

What kind of damage are we talking about to the door? Just the door, or the adjacent panels on the sides? A scratch or a dent? Pics?? If a big dent, maybe best to just get a new door?

i don't think its anything major, i have just spoke to them and they have polished/cleaned it and it looks a lot better, I have just told them i will not be picking it up until its is sorted, they are speaking with their insurance on monday to see what they think

i have asked/suggested can the ladies insurance just pay the bmw garage and that be it
