Reading the USA BMW website yesterday, I noticed that unless you have the "sport pack" option (that isn't a UK spec package) that both the 3.0i and 35i cars are restricted to 130MPH?
That basically means it goes from a 6 speed car to a 4!!
Why?
Also the 35i seems to have lost 6BHP?

Why? Insurance and liability. I think most cars are restricted to 130-135 mph. Supercars? not sure, but if you can afford one of those, you can afford the insurnace and tickets.
Besides, speed limit in most areas outside town are 55mph, interstate highways vary from 55mph to 80mph, so 130 will still get you in trouble.

seems a bit odd, what about race tracks, dont they have those with a straight long enough to get beyond 130 mph?

The tires that are equipped on a non sport pack aren't rated to goto 155. It's a liability to the factory to enable a car to go faster then the OE tires can handle. Sport pack cars have higher speed ratings on the tires from the factory.

In Germany you can't register or re-register a car whose tire rating doesn't exceed the top speed of the car. I had a 1998 318ti, US Spec in Germany and had to replace the tires in order to get a registration for it. All Z4s sold in Germany are fitted with "W" rated tires, the only exception are BMW Snow Tire sets which are "H" rated and require the shop installing them to set the speed warning at 210 KPH [130MPH].
There is also a gentlemen's agreement among German car manufacturers that their cars will be limited to 250KPH [155 MPH].
