No, because visually they are still there. Emissions wise, the primaries and their closed loop monitoring more than meet euro standards. E86's DON'T have secondary cats, they have a pair of silencers in there. Removal of these would, I think be a fail under the new rules, as any parts fitted from the factory should still be present, at least that's my interpretation of the rules.
My car still has the "cats" fitted, but as Steve pointed out, they are empty inside.
