As said elsewhere,Police were not even interested in the fact I was trying to tell them the other vehicle didn't have it's rear lights on!!
As far as they are concerned,I hit into the back of him,case closed,my fault! :x

I take it they weren’t traffic police given the nonsense about you speeding? If so then don’t throw in the towel so easily, the average police officer doesn’t have a lot of knowledge about road traffic law and a decent lawyer could make great play in court over the lack of lights on the rear of the other vehicle. Reasonable doubt is all that’s required and they haven’t examined his vehicle from what you say. Only thing is I’m not entirely sure what the light conditions were from your account.

All good other than contracting Bells Palsy 4 weeks ago. Currently have total paralysis of the left hand side of my face. Chance of full recovery are slim due to my age but early days yet. :D

That is horrible, sorry to hear about that one.

You sure they are trying to pin careless and not due care and attention? The first one is a lot worse points wise than the second.

I take it the car coming the other way would be able to confirm if they had headlights on at the front. They could have had faulty rear lights but unless this was checked at the time it will be too late now. Could you be mistaken that there were no lights on?
Its a difficult one as even if you were not speeding you were obviously going to fast to be able to stop in time. Not saying its completely your fault but its how it may be looked at.
Driving the same roads every day can make you complacent, just because there isnt normally something there doesnt mean there never will be.

The honeymoon was fantastic thanks. We had a week around Vancouver a week in the Rockies and then a week around Niagara and Toronto. The only trouble we had was an early cold snap in the Rockies and a foot and a half of snow in some places :( , two days later we’re in Niagara and the temperature is well into the 30’s :D 8) .

Married life is good, Nicola hasn’t clobbered me with a frying pan yet anyway. :P

Sorry to read this and hope the recovery goes as well as it can...

Re no tail lights they can check if a bulb was lit when it was smashed as the fragments of hot bulb burn the inside of the light unit. Obviously for this to happen the vehicle needs to be examined - doesn’t sound like they are too interested and you would have needed to smash the lights.

At least you walked away and at least it wasn’t the zed. A low sports car V the back of a flat bed? Doesn’t bare thinking about :cry:

It was dark,and yes,the other van definitely had no rear lights on,or else they were very poor!
You would of had to be doing aprox 25mph round that bend,or less,to stop in time, especially given the lack of visible lights on the tipper/, flatbed,Stuart.
Even my Dad,who drives everywhere slowly,and normally no more than 50 in a 60zone, came down that road the other day,and slowed down even more than he would normally,as I was in the car,and given what had happened recently,and pointed out that it felt as if his C max was only doing 35,when we were doing just about 40/42.

It's unrealistic to do as low as 20/25 in a 60,even round a bend,etc.
The main factor was probably the reduction in my reaction time,due to his lights not being clearly visible/not on.

Anyway, been driving for 26years,and never had this happen.
Would be worried about something running into me if I went at 1/3 of the max limit for the road,tbh :driving:
